A Resident's Plea to the City Council

The Plainfield Municipal Utilities Authority has engendered more citizen interest and controversy since its inception than any other entity since its inception about 16 years ago. Residents have gathered reams of facts from the authority's own records and documents to back their views on why it needs change, if not reform. As an example of this close scrutiny I am posting Thomas Kaercher's letter to the City Council, which he copied to bloggers, as a guest column. This letter was sent to the governing body in advance of Monday's meeting.

I attended the joint Council/PMUA discussion last Monday. As a PMUA ratepayer and Plainfield taxpayer, it is extremely frustrating that there is no one who will step up to reign in the abusive excesses of the PMUA. Before the PMUA was created, I bought trash services at market rates from a private trash company and I had no separate sewer bill; any sewer charges were recovered as part of my property taxes.  In addition, back then the City of Plainfield was owed $22.5 Million dollars by the surrounding communities for sewer facilities usage fees.  Sixteen years later, I pay more than twice the market rate for solid waste services (Grand Sanitation charges $31.07/month for curbside trash pick-up and recycling [and makes a profit doing it] while PMUA charges $66/month) and I pay almost six times the market rate for sewer services ($1,040/year here vs. $175.00/year in Cranford). In addition, during the same period PMUA has accumulated $23 Million dollars of bond debt, which the taxpayers of Plainfield are responsible for.  As part of PMUA’s solid waste fee, it collects $27.33/month for the shared service fee, which it claims is its costs to pick-up and dispose of trash in the public areas. Multiplied across the collection units in the City, this totals more than $6 Millions dollars a year or $16,400/day, 7 days a week. It is outrageous and it is more than 3 times the market rate for the same service.

The recent PMUA settlements with Eric Watson and David Ervin, totally more than $1 Million dollars is just the latest example of ratepayer/taxpayer abuse perpetrated by the PMUA. The most recent 4-year contracts were signed by Mr. Watson and Mr. Ervin in January 2010.  In addition to very generous annual base salaries ($148,600 for Mr. Watson and $124,400 for Mr. Ervin), the terms of the contracts, given the current economy, were really unbelievable).  They include a 4% cost of living raise each successive year of the contract, merit increases, a $360/month car allowance, and a total of 71 paid days off (30 vacation days, 8 personal holidays, 20 sick days, and 13 holidays) per year, which equates to over 14 weeks of paid time off each year. Then after working 18 months into their respective contracts and accruing generous pension benefits, Mr. Watson and Mr. Ervin chose to retire. They were allowed to stay on the PMUA payroll until they were compensated for all of their unused vacation and sick time. And in addition to all of that the PMUA Board of Commissioners gave them over $1 Million Dollars in settlements (PMUA resolutions 48-2011 for $275,000 and 09-2012 for $725,000 plus attorney and arbitration expenses). The $600,000.00 given to Mr. Watson is equivalent to 4 years salary and is more than the remaining portion of his 4-year 2010 contract. It was troubling that at last week’s meeting Mr. Toliver misstated the total value of the settlements, especially since voted for them.

There is no end in sight to PMUA’s abuse of the ratepayers. At last week’s meeting Mr. Young stated that he had cut back the PMUA budget $1 Million, which as much he felt was possible. The fact that the PMUA Board of Commissioners offset that savings with the settlements to Mr. Watson and Mr. Ervin not withstanding, Mr. Young said the only way to hold off future rate hikes was with the extremely uncertain revenues if PMUA is ever in position to sell services outside Plainfield. Mr. Young offered no definitive details on costs for these new services or anticipated revenues. Selling services outside the City ofPlainfield has been the PMUA pipe-dream since its inception. Mr. Young promised ‘competitive” pricing. If the PMUA pricing for these new services are as “competitive” as the rates they charge me for services, there is no chance any other community will willingly do business with the PMUA!  Also, at last months PMUA meeting Mr. Young announced his intentions to give PMUA employees an across the board a 2% Cost of Living Increase and up to a 3% Merit Increase. This is so out of touch with the current economy! If Mr. Young follows through on this it will mean that either our already abusive rates will go up again or the PMUA bond debt will have to be increased. Either alternative negatively impacts the residents of Plainfield.

It was a very sad commentary that the only way the PMUA Commissioners would agree to meet with the City Council was provided the settlement was not on the agenda. As was pointed out, the PMUA, by charter, is required to appear before the Council 4 times a year. Yet they haven’t been there since 2010. It is clear the PMUA answers to no one but itself.  They don’t have to listen to anything the Council says or even show up at a meeting if they don’t want to.  The only thing the City is empowered to do to rein-in the PMUA is dissolve it. With their compensation, self-approved benefits for part-time jobs, and their excessive miscellaneous expenses the PMUA Board of Commissioners is as big a part of the problem as the extremely high over-staffing.

First I strongly urge you tonight to reject the Mayors proposed candidates for the PMUA Board of Commissioners. According to Mr. Mitchell at last week’s meeting, the two recent appointees, Mr. Dunn and Mr. Sanders, subverted the arbitration process by making an unauthorized settlement with Mr. Watson and Mr. Ervin and then swayed the vote for approval.  Tell the Mayor she needs to put up candidates who have the independence to really oversee the PMUA and until she does, you will keep voting them down.

Secondly, and more importantly, please take the necessary steps to dissolve the PMUA.  It has been excessively over charging rate payers since its inception and is grossly mismanaged. Every year you permit the PMUA to go on, it will continue to overcharge ratepayers and its bond debt will continue to grow.

Unfortunately the City Council is compromised by extreme conflicts of interest, running to family relations with PMUA employees, as well as political ambitions that put self-interest ahead of the welfare of Plainfield residents. Most City Councils since the PMUA's inception have been looking the other way while excesses and outright legal violations have occured.

    To the commenter who asked yesterday what we can do about all this, one solution is simply to opt-out of Solid Waste service, although the number of households and businesses required to make a dent would be substantial, and there is still the sewer and shared-service fees to deal with.

    Using more discrimination in who we vote for and what the candidates have to say is of course the cleanest way to handle the mess. But our track record picking elected representatives who look out for our interests rather than their own is not very good. We could possibly force their hand by gathering signatures on an ordinance petition for dissolution. This would compel the Council to either adopt the ordinance or have it placed on the ballot and let the voters decide. However, taking this route would still require cooperation from the Commissioners because the horse is already out of the barn and unilateral action is somwhat precluded.

    My personal belief is state and/or judicial intervention will be needed. There have been numerous violations of law, particularly the wholesale dismantling of the Solid Waste Lease agreement contained within the InterLocal Agreement between PMUA and the City of Plainfield. This occured almost immediately following the adoption of the ILA, and looks very much like a bait and switch that has cost us millions over the years. I've noted this previously.

    There is also the matter of benefit and cash payments to commissioners in clear violation of the limitations set by our municipal code and supported by state statute. This is basically theft and would be just cause for the removal of 2/3s of the current sitting commissioners. A strong case can be made for this.

    Yelling, screaming, pestering, and quiet rational discourse work, but slowly. If you want change, come out to the meetings, speak your mind, and don't take "No" or mute silence for an answer. And do your research. Facts will weigh more than emotion and the walls will start tumbling down.

    We've been sold a bill of goods for years, but I sense the tide is set to change.

    Yet not everyone expressed outrage about the payouts. City Council Chairman Adrian Mapp — who long has been one of the PMUA’s most vocal critics, even campaigning on a platform to consider dissolving the authority when he ran for mayor in 2009 — said this week that he wouldn’t have changed his vote to approve Dunn and Sanders as commissioners even had he known that they would end up playing central roles in securing the funds.

  4. I usually support Mr. Mapp, but cannot support him in his support of the PMUA or Mr. Dunn. I think the City Council needs to find a way to be able to discipline or remove commissioners who do the outrageous things like those done by Dunn and and his followers. He must think he is still mayor or maybe he thinks he's Sharon. Shame on the state and City Council if they don't do their best to rescue the citizens of Plainfield from this albatross around our necks.

  5. All of these actions by the board of commissioners are a disgrace. But I’m even more disappointed in Rev. Brown not making herself available to vote on this critical issue. Was she worried about potential fallout from her vote because she wants to run for council? Or has she had sidelined conversations with her parishioner “the mayor”. If she’s not available to give her vote, is she still in the pulpit or conducting services in her church? Has she ceased the payments she gets from PMUA? Why wouldn’t she at City Council answer about her position on the settlements. QUESTIONS to be answered.

    Since there are some of us who are unemployed and TRY to keep our PMUA bills paid, let’s talk about which officials have relatives who work at PMUA: Councilman William Reid (daughter), Bridget Rivers (son), Alex Toliver (son), Adrian Mapp (brother-in-law and is TRYING to get him on the board).

  7. to anon 7:08 - Brown also had a chance to vote this past week against the settlement payment. She elected to abstain. Brokaw also had a chance to vote no, she cast her YES vote and stated as long as the former executives don't ever come back to the PMUA. This was highly organized and the payouts that were given is part of the PMUA's overall culture of corruption. Mapp like all other council members aren't vested in making it better for property owners. They are more interested in their political ambitions and the minor handouts they get at our expense.

    If you haven't called the state comptroller, county prosecutor, or governor, take 5-10 minutes and get in their ear! Don't just read what's happening, get involved. You can make a difference.

    If you haven't opted out, opt out then get two of your neighbors to do the same. Not only will you save money but you will make a huge statement. We can force the PMUA out of business.

  8. It is clear to me that Mr. Mapp has now realized that running for mayor while criticizing the PMUA did not bode well for him. So rather than standing up for what is right he is changing his position on the PMUA. That is exactly what Rashid Burney did and look at where that got him. As for Rev. Tracey Brown, she should be ashamed of herself. She has no integrity or backbone. She may think that she is helping the community by "taking from the rich and giving to the poor" kind of like Robin Hood. But theft is theft. The PMUA is not a "business" or a social services agency. It is supposed to provide a service to a community in the most efficient way possible. Instead it is a way to hook up the people in your family or your friends including people who have records and can't get employed other places. We cannot stop exposing the atrocities. We must continue to call them out and reach out to the media, the county, and state officials. When you call the prosecutor's office, governor's office, and the state comptroller they tell you they are aware of the situation. That shows that we have been making an impact. Don't stop!!!!!!

I should have taken a position. I was wrong not to have done so.”

    1. That's all nice and every thing Council President, and by the way thank you for FINALLY speaking out on this issue BUT,

      Will you vote to stop Sanders from getting a permanent position on the PMUA commissioners board?

      Will you vote to stop Malcolm Dunn from receiving a longer term?

      These questions only need yes or no responses.

      Additionally, you mentioned in the Courier news article that even had you known that they (Dunn and Sanders) would end playing central roles in securing the funds. . . you wouldn't have changed your vote.

      Is this still the case Council President?

  10. 2 easy ways to stop this:

    1: Get enough Plainfield residents stop paying their PMUA bill and switch over to private carting, and when you get your sewer bill you have to pay regardless -- DON'T PAY IT!

    2: Get the attention of the U.S and State Attorney General and the Governor to investigate

    These people are "legally" stealing the money of all Plainfield residents and the reason that so many of our leaders will not do anything about it is simply because all of the nepotism.

    The Plainfield administration and agencies who work with the city is nothing more than a staffing agency for family members of elected officials and "power"-wielding members of the administration.

    PMUA does a very good job of picking up the garbage and is also good at being crafty on ways to line their pockets with tax payer funds.

    All of the people involved in this scam are the first ones to invoke religious ideology into their public comments, as if that will redeem them somehow, after a full days work of lying, cheating and stealing; such hypocrates.

    Plainfield continues to be a three ring circus, nothing but a bunch of clowns running the town. That's why it's in such disrepair.

    Take a look around at our neighborhing communities -- they're streets are safe, their school systems are functioning, their crime rate is low, they're building town centers -- there is something wrong with this picture when Plainfield continues to be at the bottom in all respects.

    It's as if no one working for this city has a conscience.

    This City needs a good shake up, it's long overdue and Plainfield deserves better.

  11. Don't forget Cory Storch worked for the PMUA for 4 year's straight. All council member's have had family members working there, are working for the CITY or other CITIES. Let's print the facts and tell it all

LET"S SEE. I know what the problem is it's not the settlement it's the color of the men who got the settlement. let's all be real here.

To Anon 6:12 am - it's disappointing that you've chosen to inject race into the conversation, considering the fact that most would agree that it's not at all about race but rather about leadership that has a conscience; it's about the greed that overcomes these, once, well-intended individuals and how they choose to deceive the people they serve and support them, many of whom live AT or BELOW the poverty line.

    There are so many examples, in New Jersey alone, of individual(s) who have been accused and rightfully convicted of lying, cheating and stealing from their constituents; and there is no correlation between their actions and the color of their skin; plain and simple -it's about greed, not about color.

    Please consider your thoughts before making toxic remarks that will only perpetuate more hate and anger that should never be part of the conversation.

This whole PMUA thing is a travesty to the American fabric. Here we are in a town with high unemployment, substandard education system and crime and all Anon 6:12 a.m. can talk about is color? Watson & Ervin is a shameful pair to our community. Dunn, Sanders and Toliver are in the same playpin.

If there was a white man or women in control of the pmua none of this would be said. Eric Watson did a heck of a Job. He ran the authority for many many year's and I will take my hat off to him.     2. Congrats to Mr Watson and Mr. Ervin. The PMUA staff that you were there for will be thanking you when they get laid off or are asked to furlough days without pay. I'm sure the two of you are sulking at the Spain Inn or Hugo's. Oh wait, you don't get meal allowances any longer from the taxpayers.

  22. I say to all of you Please take the sheets off your head. We are no longer in the 1860's we are in 2012 and yes Black people are allowed to get what their contracts call for them to get. Read the contract nothing was done illegal. The board of commissioner's at the time gave them 2 Men their contracts. Ask the commissioner's who served at the time why did they give them suck a gift of a contract.

    1. To all the people who think they got what they deserved, you are wrong. Their contract had no such provisions. They actually got more than the contract would have paid them over four years.

      If you feel or felt they deserve something, open up your own purse or wallet. Stealing from the public is a crime. Jail may be in sight for commissioners and executives as this is clearly theft by deception.
