Demolition Investigation Sought

One of the items on the agenda for tonight's meeting is discussion on appointing legal counsel to investigate the March 21 North Avenue emergency demolition.
The demolition took place on a Saturday, although business owners were told it was scheduled for the following Tuesday. Mayor Adrian O. Mapp had called for a special meeting on March 23, by which time the building was a pile of rubble and a neighboring restaurant had been crushed. The special meeting items included a contract with Yates Real Estate to perform the demolition and appropriation of $250,000 to pay for it. The council rejected all items and City Council President Bridget Rivers called then for an investigation.

If moved the agenda, the appointment of legal counsel for an investigation will be voted on at the April 13 regular meeting, 8 p.m. in Municipal Court.

  1. The following should be noted: the demolition is incomplete. Portions of the existing structure remain. The removal of the demolition debris remains. The continued demolition will require a more considerate method than the sledge hammer technique that was employed previously. The remaining portions of the building's walls abut the walls of existing buildings.
    I hope that the City has notified Yates, in writing, that their phase 1 operations have caused extensive damage. Yates should confirm to the City that their insurance carrier has been duly notified. Yates should also provide the name of the Carrier and furnish written copies of the confirmation as well as copies of the policy. . It will be interesting to see Yates response, more interesting to see the insurance
    company's response. If the proper insurances are in place the City can breath a sigh of relief. If not, the liability may fall on the City's shoulders. Either way, absent a settlement, the City will be dragged into a suite. Absent an indemnification from Yates, which is customary in City contracts, the City will be required to pay for its own defense. Since apparently the only document that exists is a Proceed Order on a Department of Public Works letterhead, there is little prospect that the normally required indemnification exists. The litany of inappropriate procedure that occurred could fill a book. Bill Kruse

  2. I know this is off the subject but I hope you post it. I just want to say a big Bravo to Mayor Mapp on his article he posted in the Courier News Opinion section that is direct to Jerry Green. It’s not the first time Green has made homophobic remarks and it’s refreshing to see Mayor Mapp call him out on his bad behavior. If anyone didn’t read the article I urge you to do so.
