The Intolerable Mr. Toliver

Four months after Alex Toliver exploded in anger at being replaced on the Plainfield Municipal Utilities Authority, he now claims he resigned.

In his Feb. 10 outburst where the City Council voted 4-3 to replace him with mayoral nominee Charles Tyndale, Toliver became so angry he had to be escorted out by a police officer.

Before the vote, Toliver and his wife, Diane, both lashed out at Mayor Adrian O. Mapp, saying they worked hard for him, presumably in the effort that won Mapp the mayoralty in November. Toliver suggested Mapp "may be temporary" and claimed the mayor was giving away the city to "carpetbaggers." He predicted a breakdown of PMUA systems like a "tsunami" and said, "The city is going to collapse right before your feet."

While a commissioner, Toliver joined Malcolm Dunn and Cecil Sanders in a 2012 vote to give former PMUA executives Eric Watson and David Ervin additional settlements that pushed Watson's total to $901,000, up from $151,000 and Ervin's to $424,000 instead of $124,000. Toliver  now claims he was just one of six commissioners, but it only takes three votes to pass PMUA resolutions and his was one.

Now Toliver is on a rampage against Councilwoman Rebecca Williams. As reported on her blog, there was a time when he sent her flowery, flirty messages. Now he suggests she should be beheaded.

Also on Sunday,I received two similar "anonymous" replies to comments by Williams on a May 3 Plaintalker post, "About That Mailing." I published one, but then removed it. I did not publish the longer one. Here they are:

These comments have Toliver's M.O., even if posted anonymously. Maybe he realized verifiable threats are actionable.

The Plainfield Democratic situation is bad enough without anyone suggesting it advance to people "coming for you" or that "you need to be removed." Such individuals may preach political loyalty, but as one can see in "About That Mailing," dumb loyalty often leads to regret.

  1. I would be upset too if I were just let go from an appointed position that was illegally compensating me and my spouse to the tune of $15,882 a year in the form of health, dental, and vision benefits, plus the $4,500 I was legally entitled to.

    That's the 2012 figure for the Tolivers, as provided by PMUA via OPRA, and this has been going on for years.

    Other recipients of illegal PMUA payola at ratepayer expense included Carole Brokaw ($15,882, 2 adults), Tracey Brown ($7,480, single), and the big daddy of them all, Chairman Harold Mitchell ($21,549, family).

    These payments were the best way to buy loyalty from a batch of commissioners who looked the other way and were never held accountable by the City Council which appointed them. Of course you wouldn't expect anything more considering the musical chairs between the two governing bodies.

    Add in the Watson-Ervin settlement, and the formative Inter Local Agreement contract fraud of 1998 that reversed the direction of cash flow, and anyone can see the corrupting influence of PMUA that has milked Plainfield of millions every year.

Alan, No one is interested in your bias comments.There you go again accusing people of receiving illegal health benefits.If you start a job and receive health benefits, how is it illegal?Every court in New Jersey have already stated that they are justified benefits, but you know better, get over it.I look forward to you being sued very soon.One more thing, Get a Life.

  3. It's not a matter of benefits. It's a matter of total compensation. I could care less if you (yes, you Anon) got $4,500 in healthcare benefits. The fact of the matter is the City ordinance limits your compensation, and none of this has been settled in any court.

    Sec. 3:35-7. Compensation.

    Members of the Plainfield Municipal Utilities Authority may receive compensation for their services as members of the Plainfield Municipal Utilities Authority within the limitation herein stated, that no member shall receive compensation, either direct or indirect, in excess of Four Thousand Five Hundred Dollars ($4,500.00) per annum.

    And yes, I should get a life, because it's almost one keeping tabs on the official corruption in Plainfield that keeps showing itself again and again under all sorts of guises.

    1. Thank you for your comments Alan, a lot of us is interested. Anonymous 12:27 pm is not only a coward by not printing their name, but obviously a liar. It’s absolutely amazing that people can write such bold-face lies and convince themselves that most of Plainfielders are just so lazy we would never verify anything. Truth be told, for the most part they are right, most of us are lazy. Hence the last election, turnout and results.

    Thank you for posting about Alex Toliver’s rants. His comments are incendiary and very dangerous indeed. It is important the city knows about his. Hopefully something can be done to stop him from doing more things like this in the future.

    To Anonymous at 12:27, it is too bad you don’t have the courage to sign your name to your comments. Alan states the facts about how the PMUA commissions have stolen money from Plainfield taxpayers by giving themselves benefits they were never entitled to and how Commissioners Dunn, Sanders, and Toliver subverted a legal process to give a $1,000,000 bonus to two executives who had resigned, when they were NOT entitled to any bonus according to the employment contracts they had signed.

    Maybe you don’t care about public funds being misappropriated, but many, many Plainfield taxpayers, myself included, are appalled by the rampant corruption that has been the hallmark of how Plainfield has been run for the last 20+ years.

  6. Legal question: are publicly-made threats to elected officials actionable? If so, Mr. Toliver's rants certainly qualify and the appropriate action should be taken!

Regarding the sweeping health benefit package that PMUA Commissioners enjoyed, and some still do, the rationale posed by the PMUA Council, Ms. London, was that IRS regulations exempt the amounts paid by employers for Health Benefit premiums from taxation. This is true. However, the amounts paid are COMPENSATION, albeit a non-taxable compensation .End of story.
    Newly appointed Commissioners no longer receive a Health benefit package. It is reasonable to conclude that the elimination of this benefit was not triggered by a compulsion to reduce PMUA costs, rather by the recognition that the practice was patently illegal and at some point it would be legally challenged with potential adverse consequences.
    The big ticket concerns are that the City budget continues to increase while tax rolls diminish. This is not sustainable. It remains our hope that some comity within the City council can be achieved and matters of importance addressed rather than focusing Mr. Toliver's inane rants. The very best way to respond is to ignore him. Bill Kruse
