Council Report: Meshugenah Monday

The controversial paid sick leave ordinance was tabled indefinitely Monday, but a night club license for which police recommended denial was approved instead in a 4-3 vote.

The surprise topic of the night turned out to be changes at the Senior Center, about which more later.

Though it has been in the works since February, opponents of the paid sick leave plan said not all businesses have been made aware of it. Proponents said it has been discussed with business owners and a meeting is scheduled for today to continue talks. The legislation would allow workers to earn one sick day for every 30 days worked, among other provisions. In response to business owners, it had already been modified to lower fines for noncompliance and to do away with public naming of violators.

Both issues got a boost before Monday's meeting from social media, paid sick leave with a Facebook link to an online Courier News story about a poll that found 80 percent of Plainfielders favored the legislation. The poll was commissioned by the activist group New Jersey Working Families Alliance. But Nimrod Webb, president of the Special Improvement District association representing 400 businesses, dismissed the results in the article, saying any poll can be skewed.

If in fact the sticking point is informing all business owners, it is a tall order. The SID includes the central business district and a portion of South Avenue, but across the city there are more than 2,000 businesses, according to Census figures from 2007. City officials have long talked of creating a business registry, which would have made electronic outreach in English and Spanish easy.

The blog Plainfield Latino also made a Facebook pitch, for people to come out in support of the owner of the Richmond Street night club. A police investigation led to a recommendation for denial of his 2015-2016 liquor license, but a council majority declined to hold a hearing and agreed last week to vote on renewal of the license, along with numerous others. The Express Night Club was the only one receiving a police recommendation for denial. Police had also opposed a license transfer to owner Luis Penaloza for the 2014-2015 year ending in June. Plainfield Latino cast the situation as a plot by Mayor Adrian O. Mapp to shut down Latino businesses.

Before the vote on the license renewal, Councilman Cory Storch urged his colleagues to hold a hearing on the police reports and the "serious violations" that were uncovered. He said it was "a real disservice to this discussion to say we are trying to shut this establishment down."

Storch described the hearing process and said, "Then you make a decision."

In past hearings, the council in its role as the Alcoholic Beverage Control Board has imposed conditions on liquor establishments in violation, such as requiring security guards or training for employees on ABC rules. Storch said the state ABC would likely reject a denial, as it prefers "progressive discipline" for license holders.

When the renewal passed, audience members including other bar owners broke into applause.

The Senior Center issue began as a discussion item for the council. Rivers said there were rumors of it "phasing out" or merging with Recreation. City Administrator Rick Smiley said the change was only a "health and wellness expansion" led by Recreation Superintendent Veronica Taylor. He said the longtime center supervisor, Sharron Brown, and center staff would remain in place.

Council objections included doubt that Recreation could serve both youth and seniors, and concerns that Brown would lose her job. Rivers said although it was the prerogative of the administration to make changes, the council should have been informed. Gloria Taylor sparred with Smiley over Veronica Taylor's ability to handle the expanded program.

"The administration does not share your opinion," Smiley said, to which Gloria Taylor retorted, "Well, we handle the budget, so keep playing with us."

In public comment, a stream of seniors questioned the change and expressed great love for Brown. Some argued her title is director, not supervisor, and said that is how she is identified on the city web site.

Regarding the twists and turns of the paid sick leave law, the decision-making process for legislation involves several junctures. Council President Bridget Rivers can decide not to put resolutions or ordinances on the agenda in the first place. Items must receive at least a four-member council consensus at the agenda-fixing session to be up for a vote at the regular meeting. Ordinances must pass on two readings, so even if the council agrees one month to pass an ordinance on first reading, it still has the hurdles of getting on the agenda and passing on second reading. If the mayor vetoes the ordinance, it then takes five council votes to override it.

The paid sick leave ordinance received unanimous approval on first reading in February, but an outcry from business owners in March led to postponement until April. It then failed, 3-3, with "yes" votes from Cory Storch, Rebecca Williams and Tracey Brown and "no" votes from Gloria Taylor, Diane Toliver and Rivers. Vera Greaves was absent. Despite dissension, it was moved to Monday's agenda in a 6-1 consensus, with only Taylor objecting.

The meeting Monday went downhill fast when former PMUA Commissioner Alex Toliver came to the microphone in general public comment and made homophobic remarks to Williams, the only openly gay council member. He began by saying a harassment charge brought by Williams last year was dismissed in court. Toliver, whose wife Diane is now a council member, had suggested that Williams should be beheaded for not saluting the flag. Next he denied flirting on Facebook with her, saying he would not flirt with "a woman who dress like a man, walk like a man."

Toliver's conduct set off a round of apologies and expressions of sympathy from Williams' colleagues for having suffered his remarks.. Williams said a Westfield judge had found the remarks did not meet the strict interpretation of harassment and so dismissed the charges.

Barring any special meetings, the next City Council agenda-fixing session meeting will take place at 7:30 p.m. on Oct 5. The regular meeting will be at 8 p.m. on Tuesday, Oct.13.

Bernice you forgot to mention that Rivers blamed "the blogs" for inciting Toliver's remarks and then made it about herself by saying that she has been beat up by the blogs, basically suggesting that because Williams was elected, it goes with the territory. What a great council president, blaming the victim for the hateful remarks. She should of shut it down but she seemed to think the stunt of calling Williams a councilman was amusing. The tape will tell the tale when it airs.

  3. Bridget should be ashamed of how these sessions are conducted. The council members are vile to one another - council members are rude to the public - and the public obviously because they have no respect for the council, is rude to the council.

    This council acts like a group of prepubescent kids who have been raised with no manners, no self respect, and no concern that they have no respect from people who have no agenda other than making Plainfield better.

  4. I wonder why those of you have so much to say anonymously..... Councilwoman Williams used this whole stunt to gain support and favor.. Toliver was rude but he was expressing his opinion that she looks like a man and dresses like a man. However wrong he might have been in his approach it was still only his opinion which we all have.. He said nothing about her being gay or her sexual status. Williams is by far the rudest and most disrectful member of the council. She turns her back on our flag but not on her flag. She doesnt respect her fellow council members and frequently storms our of meetings making boisterous remarks while doing so.. Dont throw rocks then hide your hand.. Again there were no remarks made that were derogatory or homophobic and if so doesnt one have a right to their fears if one has the right to be gay

I rarely if ever comment but what he said was disgusting and for the council president to allow that speaks volumes of how utterly far we have fallen that disagreements on policy have turned into petty name calling.

      This city needs to rise above this kind of nonsense because we are being left behind by every surrounding town because of petty nonsense that started in the 90s.

Also when Ms. Williams attends council meetings she looks like she is mad, bored, never smiles, and when things do not go her way she gets up and leaves the meeting.     7. Anon 1:36 - its sad to say - and I voted for Rebecca - but she has "stormed" out during council meetings. The most recent was for the Agenda Fixing to put south ave PILOT on agenda - Councilman Storch was on speaker looking for someone to second his motion and his council partner had hit the road. I have seen it other times of high frustration too - either that or she has a lot of commitments that she has to leave early for.

Bernice let's talk about the corruption that is going on here in the city of plsinfield. Why are they trying to get rid of the planning board so they could get neirdstadt out the way. This administration is tearing this city apart and some want to turn the blind eye. Just sit back and watch as people go out on hand cuffs

    3. 9:09am - you cannot take a liquor license away from one bar and give it to another. I am not even sure if the stip club owner would lose it, or just not be able use it.

      Liquor licenses can be sold privately, and if Cretella bought the license, he also would have to go in front of the council to get it approved. You have no idea what you are talking about.

  6. Hi bernice I wasn't there last night so I will have to get all the,details before I can make a sound decision. If mr. Toliver did make those statements I think his wife council women toliver should apolijize to council williams. I must also say that I am sorry I couldn't get there to speak on behalf of the senior center. What mayor mapp is doing to this city is a disgrace. Ask yourself why would you have 2 people making over 80 000 dollars to run progrsms. Evenly ms brown will be gone just like the planning board. As far as the liquor license mr. Cretella have been running around trying to get a license for some time now. The council need to look into his 11 properties he own

    4. The Jerry Green line of Council members, Rivers, Taylor, Greaves, and Toliver are holding the city back and sometimes acting like street thugs. They don't use or understand Robert's Rules of Order or common courteousness, though the will talk about being disrespected in a minute. I haven't heard about being "disrespected" since Ieft teaching in Newark's Central Ward. Very street, but not very professional.

  8. 9:09 & Renee, a correction; Administration is not planning to eliminate the "Planning Board" which is an independent appointed body of citizens per the Charter. Their target for unknown and unsupported reasons is the Planning Division a part of the city administrative structure.

    2. Richard - you may want to research the city charter a little. The planning board is independent of the mayor. He can appoint members but he doesn't influence the outcome - with or without an outsourced planning department. The Mayor has one vote on the planning board like all the other members. Any deviation from that would require a change to the city charter. Aren't you a lawyer?

Olddoc mentioned the Mayor wanted to dissemble the Board as an independent appointed body and reincorporate it under the Planning Division (a unit under the city administrative). This move would remove the independence of the board and put it directly under the authority of the Mayor.

      And yes I am a lawyer, but this was just common reading comprehension.

      And for the record (again) - the Mayor would have the same basic authority over the planning DEPT outsourced that he does now. And if you study your charter you will understand that the Mayor outsourcing the planning DEPT does not in any way effect how the Planning BOARD functions - changing that requires council and state approval.

      And btw - dissemble doesn't mean what you think it means.

  9. This council is such a bunch of clowns. It can often be quite entertaining but at this point the show is very tired. They are rude to the public, they fail to understand what their roles and responsibilities are, they don't read their packets - or understand them on the rare occasions they do read them. They are rude to each other and waste the public's, and their own time, with all this school yard nonsense. The comments about Ms. Williams were moronic, but they were spoken by a fool who has the right to express his opinion. You have to take the good with the bad.

    And by the way - I am not excluding anyone from my critic of the council - they should all go. A pure waste of time every single one of them.

  11. Council women Williams is an embarrassment within her self as a public official she turns her back to the flag she leaves meetings abruptly. For the people to try to turn this into gay asking it's wrong. I was,there last night and Mr toliver said nothing about her life style. The real issues that are facing plainfield right now some want to turn their backs to it. The senior center the reception department the planning division our taxes going high and tge list goes on. This,city is,heading to hell under this administtion. This is the worst I have,ever seen it. I know the late great Albert mc williams is turning in his,grave

  12. Sick leave ordinance is disguised as a health ordinance when in fact it is a labor ordinance and should be treated as such. The ordinance that was tabled had violations going before municipal court. Municipal Court Judges are not labor judges. Where does the State Department of Labor stand on these sick.leave ordinances? Why would they give up.power to local municipal courts?

  13. I am a Christian and proud to be an American, but I leave out "under God" in the pledge and don't think a prayer is appropriate in a City Council meeting. I don't disparage people who do not believe in saluting the flag, that is their prerogative. I also don't appreciate homophobic remarks from people with shady, at best, backgrounds. The leadership of this council is the worst I've seen in over 20 years. I can't wait until that changes, but the City will suffer until then.

If you put the Sr. Center under the Division of Recreation, The Sr. Center Director will have to be moved from their current PMMA union to the PMEA Union because you cannot have an individual that has supervision over another person in the same union. Now a new salary ordinance would have to be presented to Council. I smell another individual being included in a layoff plan which includes the Planning Division.

  18. The Bar is a previously approved legitimate business and has been operating under auspices of the Law of the State as required. The fact that a group of individuals is trying to take this mans livelihood for no other reason other than giving it to someone else for their own personal gain.. Ask Mr. Mapp who renovated is fabulous new kitchen???

I don't understand.. there are many types of bars in this town.. that bar wasn't open 2 days before the police were trying to shut them down after being approved for the opening. they had dancers there in shorts no thongs.. people like different things. let them alone. if they violate something fine them. don't make up stuff or try to extort them

    1. There really is no such thing as a gay strip club - but if an applicant came in an expressly stated that is what they wanted to do it would be interesting to hear the comments. How that relates to this I do not know - since this establishment is not supposed to be a strip club - hence the issues.

  21. Mr Dunn just cares about himself and making money so he can act like a big shot. That is why he has big parties at his house. He even takes care of police so when young people drink and smoke during his parties they don't get arrested. He has a large sense of entitlement here in Plainfield.
